Should your property be suitable and meet all criteria, CO2 Australia would seek to formalise an agreement. This involves the landholder entering into a carbon sequestration agreement which allows CO2 Australia, or one of our clients, to own a right to the carbon within the trees planted on the property. An important element of these agreements is the consent of any encumbrances on title such as a mortgagee before any planting works begin.

Once the agreements have been finalised and the planting areas determined, a payment is made to the landholder based on the area planted to trees on the property. This payment is usually determined by reviewing land values in the district and can either be an ongoing annuity payment or an upfront payment. This payment is in recognition of the long-term nature of the CO2 Australia Carbon Sequestration Program. In return, CO2 Australia takes an interest in the land called a Carbon Sequestration Right.

Details of the Carbon Sequestration Right include:

  • the landholder still retains title and ownership of the land;
  • current or future owners cannot remove or harvest the trees for the duration of the Carbon Sequestration Right Term (usually in excess of 100 years);
  • all the benefits of the carbon stored in the trees (the Carbon Rights) are owned by CO2 Australia, or a client of CO2 Australia;
  • at the end of the agreed term, the Carbon Sequestration Right expires and the landholder is free to use the land as they please; and
  • although the Carbon Sequestration Right on the land is transferred to the new owner when the property is sold, it does not require any additional difficult steps in the sale process.

In addition to the payment to the landholder, CO2 Australia will pay for all establishment and ongoing maintenance costs in relation to the planting, as well as costs associated with mapping and planting design.
